1. Acceptance of Terms

By accessing or using the Pallet Colorado website at palletcolorado.com (the "Site") or purchasing any products or services from Pallet Colorado ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use our Site or services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Services

Pallet Colorado provides pallet-related products and services, including but not limited to:

  • Sale of new and recycled wooden pallets in various sizes and grades
  • Purchase and pickup of surplus or used pallets from businesses
  • Pallet recycling and responsible disposal services
  • Pallet repair and refurbishment
  • Custom pallet manufacturing to client specifications
  • Transportation and delivery services within our service area
  • Pallet management programs for ongoing supply needs
  • Heat treatment services compliant with ISPM-15 international standards

Service availability may vary by location. We primarily serve the Denver metropolitan area and the Colorado Front Range, with extended service available throughout the state of Colorado.

3. Pricing and Payment

All prices quoted by Pallet Colorado are in U.S. Dollars and are subject to the following terms:

  • Quotes: Price quotes are valid for 30 days from the date of issuance unless otherwise stated. Quotes are based on current material costs and availability and are subject to change.
  • Pricing Fluctuations: Pallet pricing may fluctuate based on lumber market conditions, availability, and seasonal demand. We will always confirm final pricing before processing an order.
  • Payment Terms: Payment terms will be established at the time of order and may include payment upon delivery, net-30 terms for qualified commercial accounts, or other arrangements as agreed in writing.
  • Taxes: Prices do not include applicable sales tax or other government-imposed fees, which will be added where required by law.
  • Late Payments: Overdue invoices may be subject to a late payment fee of 1.5% per month on the outstanding balance.

4. Delivery and Transportation

Delivery of pallets and products is subject to the following terms:

  • Delivery Area: Standard delivery is available throughout the Denver metropolitan area and the Colorado Front Range. Deliveries outside this area may be available at additional cost.
  • Scheduling: Delivery dates and times are estimates and are not guaranteed. We will make reasonable efforts to meet agreed-upon delivery schedules, but we are not liable for delays caused by weather, traffic, equipment failure, or other circumstances beyond our control.
  • Delivery Fees: Delivery fees, if applicable, will be quoted at the time of order. Minimum order quantities may apply for free delivery.
  • Receiving: The customer is responsible for having adequate personnel and equipment available to receive and unload deliveries at the scheduled time. Additional charges may apply for wait times exceeding 30 minutes.
  • Risk of Loss: Risk of loss and title to products passes to the customer upon delivery to the specified delivery address.

5. Returns, Refunds, and Disputes

We stand behind the quality of our products and services:

  • Inspection: Customers should inspect all pallets and products upon delivery. Any issues with quantity, grade, size, or damage must be reported within 48 hours of delivery.
  • Returns: Returns may be accepted within 7 business days of delivery, provided the pallets are in the same condition as delivered and have not been used. Return authorization must be obtained in advance by contacting us at info@palletcolorado.com.
  • Refunds: Approved returns will be refunded via the original payment method or as a credit toward future orders, at our discretion. Delivery fees are non-refundable.
  • Disputes: If there is a dispute regarding the quality or grade of pallets delivered, we will work with the customer in good faith to resolve the matter, which may include replacement, exchange, or partial credit.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Pallet Colorado provides all products and services "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • In no event shall Pallet Colorado, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of our products or services.
  • Our total liability for any claim arising from or related to our products or services shall not exceed the total amount paid by the customer for the specific products or services that gave rise to the claim.
  • We are not responsible for any damage, loss, or injury caused by improper use, storage, handling, or modification of pallets after delivery.

7. Intellectual Property

All content on the Pallet Colorado website, including text, graphics, logos, images, and software, is the property of Pallet Colorado or its content suppliers and is protected by U.S. and international copyright laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our Site without our prior written consent.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pallet Colorado, its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of our Site or services, your violation of these Terms, or your violation of any rights of a third party.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute arising under or relating to these Terms or the services provided by Pallet Colorado shall be subject to the exclusive jurisdiction of the state and federal courts located in Denver County, Colorado. You consent to the personal jurisdiction of such courts and waive any objection to the convenience of such forum.

10. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
